SCOTUS Spanks White House

From the lovely and talented Blognonymous, a review of the Supreme Court's decision in Hamdan v. Rumsfeld, wherein the court found the use of military tribunals for "detainees" unconstitutional as it violates the Geneva Conventions, to which the US is bound by treaty.

It now looks like Bush is going back to the drawing board with Congress to draft something that might pass constitutional muster. We'll see. The Detainee Act didn't.

Not sure how they will manage to draft a law that will allow the President to violate treaties, since the Constitution requires us to consider treaties as the same as federal law.
